According to the WSJ, in addition to tariff policies, the U.S. Trump administration is advancing a longer-term strategic layout to establish a new global trade rule system around cross-border data flow, cloud computing, software, and artificial intelligence through agreements with major trading partners.
The report states that currently, 43 legal jurisdictions worldwide have implemented 146 digital trade barriers, including digital services taxes, data localization requirements, restrictions on cross-border data flows, and measures requiring companies to hand over source code, technology, and business data. The United States believes that these rules are weakening the competitiveness of its domestic technology companies and digital economy.
The agreements recently reached by the United States with countries such as Indonesia, Cambodia, and Malaysia have incorporated clauses that prohibit forced technology transfer, ensure free cross-border data flow, prohibit government requirements for companies to submit source code, and maintain duty-free electronic transmissions, establishing the preliminary framework for digital trade rules in the AI era.
